What Services We Provide
We provide credit assistance and mortgage broking services, which includes:
- Assessing your borrowing needs and capacity
- Sourcing and comparing home loans, investment loans, refinancing options, and SMSF loans from our panel of lenders
- Recommending suitable loan products and structures based on your individual circumstances
- Assisting with loan applications and managing the process through to settlement
Important: We provide credit assistance only. We do not provide financial product advice, tax advice, or legal advice. These services require separate, appropriately licensed professionals.
Our Obligations to You — Best Interests Duty
As mortgage brokers, we are subject to the Best Interests Duty under the NCCPA (effective 1 July 2020). This means we are legally required to act in your best interests when providing credit assistance for home loans, investment loans, and refinancing.
In practice, this means we must:
- Prioritise your interests over our own or those of a lender
- Make reasonable enquiries about your requirements, objectives, and financial situation
- Recommend credit products that are suitable for you
- Manage any conflicts of interest that could influence our recommendations
How We Are Remunerated
We receive remuneration from lenders when a loan we arrange is settled. This is paid by the lender — not by you. Our remuneration typically consists of:
| Upfront Commission | A one-off payment made by the lender at loan settlement, typically calculated as a percentage of the loan amount (generally in the range of 0.55% – 0.77% of the loan amount, inclusive of GST — however this varies by lender). |
| Trail Commission | An ongoing payment made by the lender for the life of the loan, typically calculated as a percentage of the outstanding loan balance (generally in the range of 0.165% – 0.275% per annum, inclusive of GST — however this varies by lender). |
| Clawback | If a loan is repaid within a specified period (typically 12–24 months), we may be required to repay some or all of the upfront commission to the lender. We do not pass this cost on to you. |
We do not charge you a fee for our credit assistance services in most circumstances. If a fee is applicable in your specific situation, we will disclose this to you before proceeding.
Our staff members may receive a salary, bonus, or commission based on overall business performance, but are not incentivised by individual loan commissions in a way that would conflict with our Best Interests Duty obligations.
Our Lender Panel
We access loan products from a panel of lenders including major banks, regional banks, non-bank lenders, and specialist lenders. The specific lenders we work with may change from time to time. We will inform you of the lenders we are comparing your loan options across as part of our credit assistance process.
We do not have an ownership interest in any lender on our panel, and no lender owns us, unless disclosed to you separately in writing.
Your Privacy
We collect personal and financial information about you in order to assess your credit needs and assist with your loan application. This information is handled in accordance with our Privacy Policy, which is available on our website at www.nexusprivate.com.au/privacy-policy/.
We may share your information with lenders, valuers, and other third parties as required to process your application. We will not share your information for any other purpose without your consent.
Conflict of Interest
We are committed to managing conflicts of interest in accordance with our obligations under the NCCPA and our Best Interests Duty. Key conflicts that may arise include:
- Commission from lenders: We receive commission from lenders whose products we recommend. We manage this conflict by recommending products based on your needs, not on the commission we receive.
- Referral arrangements: Where we refer you to other service providers (such as accountants, financial advisers, lawyers, or property specialists), we may receive a referral fee or have a commercial relationship with that provider. We will disclose any such arrangement to you at the time of referral. You are not obliged to use any referred provider.
